Oftentimes such cases are a result of an Adult Protective Services (APS) investigation. Court Rules Medicare Beneficiaries Can Appeal Switch to Hospital Observation Status
A federal court has ruled that hospitalized Medicare beneficiaries who were switched from inpatient to observation status can appeal the decision, making it easier for them to receive coverage for subsequent nursing home care.
This is important because prior to this ruling, patients who were admitted under observation would be billed under Medicare Part B instead of being billed under Medicare Part A, which covers inpatient services. This means patients would owe a co-payment for every service offered. The total co-payment could be much larger than the one-time deductible patients have to pay under Part A.
