This month we will be sharing content about adult and minor guardianship, elder abuse, neglect, and financial exploitation. At Dutton Casey & Mesoloras, our attorneys not only represent clients in guardianship cases, but we also serve as Guardian Ad Litem: a court-appointed advocate during guardianship cases. As well, we represent clients in litigation cases involving elder abuse and financial exploitation.

Our Client Care Coordinator, Monica DiOrio, has served as a guardian representative for an elder law firm in Indianapolis and has worked as an Adult Protective Services Caseworker. During those roles and her other experience in the field, Monica is well-equipped to speak with potential and current clients on the guardianship process or concerns related to elder abuse, neglect, and financial exploitation.

When Can Someone Be Declared Legally Incompetent?

Guardianship is dependent on one's cognitive capacity. What constitutes "capacity" and are there standards to determine incapacity? This article gives an introduction to these concepts.
Abuse, Neglect, Financial Exploitation

In addition to our guardianship services, Dutton Casey & Mesoloras has experience representing clients in litigation cases related to elder abuse, neglect, and financial exploitation. Oftentimes such cases are a result of an Adult Protective Services (APS) investigation. Our Client Care Coordinator, Monica DiOrio, worked as an APS caseworker before joining our firm and is passionate about serving vulnerable adults. Partner Amy Gjesdahl shares this passion and focuses her practice on complex guardianship and adult protective services cases, which involve such things as financial exploitation.

Court Rules Medicare Beneficiaries Can Appeal Switch to Hospital Observation Status

A federal court has ruled that hospitalized Medicare beneficiaries who were switched from inpatient to observation status can appeal the decision, making it easier for them to receive coverage for subsequent nursing home care. 

This is important because prior to this ruling, patients who were admitted under observation would be billed under Medicare Part B instead of being billed under Medicare Part A, which covers inpatient services. This means patients would owe a co-payment for every service offered. The total co-payment could be much larger than the one-time deductible patients have to pay under Part A.
