Topic: Surrogate Decision-Making: The Ethical and Legal Considerations for Adult Patients With and Without Capacity

Summary:

When a patient has an uncertain level of cognitive capacity, what is the legal hierarchy for surrogate decision-making? How can you be sure you are following the correct person’s directives? What resources can be shared to prevent the need for an emergency guardianship? This session, presented by a Certified Elder Law Attorney, will discuss such questions and review the legal remedies to pursue when all other options have been exhausted.

The discussion will be framed from a medical ethics perspective, including the principles of autonomy, justice, beneficence, and non-maleficence.
